Portability of Disclosures

 

Colleges are reminded of the concept of portability, which refers to the re-use of a disclosure obtained for a position in one organisation for a position in another organisation. 

Portability inherently carries a degree of risk; in deciding whether to accept a previously issued Disclosure, colleges should consider the age of the Disclosure provided; Disclosures carry no formal period of validity and the information contained on the Disclosure reflects the information available as at the date of its issue. It is therefore advisable to obtain a fresh Disclosure if the previously issued Disclosure is over three months' old. 

Colleges should also consider whether the level of Disclosure required (ie Enhanced or Standard) is the same and that all levels of checks required are covered.  In addition, the CRB check may not have included a check of the new barred lists. 

If colleges decide to accept the Disclosure presented to them, they should contact the registered body named on the front of the Disclosure in order to confirm its contents. The applicant's prior consent must first be obtained. The CRB no longer facilitates portability. 

If colleges have any cause for concern, a fresh Disclosure should always be requested of the applicant.

RESULTS OF DISCLOSURE 

In deciding the relevance of any convictions revealed, the nature and age of the offence(s) should be considered. In general, convictions for sexual, violent, drug or deception offences will be particularly strong contra-indications for work with children.

Those who will be working in regulated or controlled activity will also be eligible for a check against the barred lists.  In respect of those people, information held on those lists by ISA will also be revealed. 

The CRB does not check whether an applicant is permitted to work in the UK.
