Implementation of the New SchemeImplementation of the New Scheme 12 October 2009 Since 12 October, the two new barred lists are being phased in and will eventually replace the existing lists (PoCA, PoVA and List 99). Although since 12 October there have been criminal sanctions for barred individuals who seek work with vulnerable groups and for employers who knowingly take them on, there will be no legal obligation on employers to check the lists until November 2010, by which time any person moving or recruited to work in “regulated activity” is required to have registered with ISA. Colleges have also, since 12 October, had a duty to refer to the ISA any information about individuals who may pose a risk, such as those who have been dismissed or who have resigned, because they harmed, or pose a risk of harm, to a child or vulnerable adult. April 2010 Colleges who do not know whether a new entrant or mover into controlled activity is barred for regulated activity will have to apply to the CRB for an enhanced disclosure with a barred list check on that individual. 26 July 2010 From this date workers (or volunteers) who are new to working with vulnerable groups or who switch jobs will be able (but not obliged) to register with the ISA. November 2010 From this date, it will be a legal requirement for new entrants into regulated activity or those who change roles to perform a regulated activity to be registered with the ISA, provided of course they are working with children or vulnerable adults in a regulated activity. Further, it will be a legal requirement for colleges to check the status of these individuals before they commence work in regulated activity. From 1 April 2011 Members of the existing workforce who work in regulated activity will be phased into the scheme from this date. It has been suggested that this will begin with employees who have no CRB check, then those staff whose CRB checks are the oldest. Institutions will have until 21 July 2015 to ensure that all those working in regulated and controlled activity have gone through the registration process |
