common law duties
Governing bodies are subject to common law duties which are established through case law. Clerks are not required to know detailed areas of case law, but it is necessary to be aware of the general common law duties which apply. These include the duties of loyalty, good faith, care, diligence and skill expected of governors because their role places them in a position of trust. |
