Powers of the Governing Board

Under sections 18 and 19 of the Further and Higher Education Act 1992, the governing board has the power to:

  • provide further and higher education and training
  • provide and participate in the provision of secondary education to over 14’s
  • supply goods and services in support of the provision of education
  • conduct an educational institution
  • provide facilities necessary or desirable to exercise its other powers
  • subscribe for, or acquire shares in, or securities of, a company or charitable incorporated organisation
  • acquire and dispose of assets
  • enter into contracts
  • borrow and invest money and accept gifts

    The governing board also has powers to do anything which appears to it to be necessary or expedient to exercise any of the first three powers mentioned above.

    The legal power of the governing board rests with the governing board as a whole, not with individual governors.
